Colorado Springs police say a black man wielding a stun gun held up a downtown store Saturday night.

Colorado Springs police were called to the Family Dollar store at 22 N. Spruce Street just after 7:30 p.m.

Witnesses told officers the man came into the store and used the stun gun to get an employee to walk to a register and pull out cash.

The robber fled the store with an undisclosed amount of cash and he hadn’t been found early Sunday.

A fight at an Indianapolis middle school that drew a crowd of about 100 kids ended in police using stun guns on three teen boys who were fighting.

Indianapolis Metropolitan Police Department said one of its officers, an IPS liaison, was on detail at John Marshall Community High School when he heard noise coming from the auditorium and rushed to investigate along with an IPS Police officer. They found a crowd of students yelling and jumping over seats to get closer to a fight, according to police reports, and two students were attacking another student.

An assistant principal was able to separate the fighting teens – one of them 14, and the other two 13 – and the IPS officer escorted them out of the auditorium while the school official tried to calm the rest of the students.

Once outside the auditorium, however, the three students again started fighting, police reports said. The school official tried to intervene but ended up knocked to the floor, wrestling with the students, police reports said. When the students disregarded the IMPD officer’s orders to stop fighting, he used his department-issued stun gun on all three of them, and had to stun two of them twice, according to police reports.

The three were checked out by medics on the scene, and were later taken to Wishard Memorial Hospital and were preliminarily charged with disorderly conduct and resisting law enforcement,

Bradley E. McCarty, of 11400 Range Lane in Marissa, was charged with aggravated battery to a peace officer in connection with the incident at 1:30 a.m. Tuesday.

St. Clair County Sheriff’s deputies responded to a disturbance call at the Range Lane address. McCarty’s wife, Melissa McCarty, called police because her husband came home “extremely intoxicated and belligerent,” according to the police report.

     
Melissa McCarty reported she and her husband were arguing over money and Bradley McCarty was throwing things and smashed a beer bottle in the kitchen. She told police that Bradley McCarty told her he was going to smash her car with the tractor, then left in his pickup truck.

When deputies arrived, McCarty pulled up behind them in his truck, got out and started shouting and ranting at the deputies. He told them to get off his property while ignoring an officer’s commands to stop walking toward them, the report stated.

McCarty continued to walk toward the deputy and shoved him. The deputy attempted to place him under arrest, handcuff him and was shoved again, according to the report.

The deputy used a Taser on McCarty and was able to handcuff him. McCarty was previously shot with a Taser for resisting arrest by the New Athens Police Department.

He also was cited for driving with a revoked license. His license was revoked in 2009 for driving while his license was suspended for driving under the influence of alcohol.

McCarty posted bond and was released.

JUNEAU — The Alaska Supreme Court on Friday reversed a judge’s finding that a Kotzebue police officer who used a stun gun on an 11-year-old should get immunity in the case brought by her mother.

The justices determined that a lower court had erred both in granting Lee Virg-In qualified immunity and dismissing Sandra Russell’s claims that the city had improperly and negligently trained or supervised Virg-In. The matter was sent back to a trial court.

Russell’s attorney welcomed the news, and an attorney for the city, Joe Evans, said he is prepared for trial. Evans said Virg-In is no longer employed by the city and is working as a teacher in North Pole.

The case dates to 2003, when, according to court papers, a then-11-year-old girl, identified as J.N., ran stop signs with an ATV, drove recklessly and ignored warnings — the use of overhead lights and a police car siren — to stop. At one point, the ATV stalled and the girl and her young passenger began running from Virg-In. J.N. ignored calls to stop but said she stopped “right away” when she ran into a group of teenagers on the street.

It was then, according to court papers, that she said she turned and saw the officer and he pulled out and twice used a stun gun on her. Virg-In described J.N. in an incident report as standing five feet tall, weighing 100 pounds and having a slender build.

She was arrested and later adjudicated for a misdemeanor of “failure to stop at the direction of a peace officer in the second degree.” In 2005, her mother, Russell, sued, alleging Virg-In used excessive force.

According to Friday’s ruling, a lower court found “triable issues” as to the reasonableness of Virg-In’s actions but ultimately determined there was no clear law that would have alerted him to the fact his actions were unlawful. The superior court found that in light of J.N.’s prior efforts to escape and her “reckless behavior,” it was “not so egregious or lacking in common sense” that he would have known it was excessive.

Justice Dana Fabe, writing for the high court, said issues such as whether J.N. was fully compliant and not fighting must be resolved at trial before a determination can be made on whether Virg-In’s actions were egregious or he’s entitled to qualified immunity.

The court also set aside an order that Russell be liable for about $43,000 in legal fees. In state court, winning parties can seek up to 20 percent of their attorney fees in cases where money is not at issue.
